1. Acceptance of these Terms
These Terms & Conditions (the "Terms") govern your access to and use of the website at oralminoxidilonline.com (the "Site") and any healthcare services you receive through this Site from Midwest Mind & Body Healthcare (the "Practice," "we," "us"). By using the Site, submitting an online intake, or receiving a prescription through our service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site or our services.
These Terms form a binding legal agreement. Before a prescription is issued, we will ask you to sign additional intake and consent documents (informed consent for treatment, HIPAA acknowledgment, and a Stripe payment authorization for the provider review fee). Those documents govern your clinical care and, where they conflict with these Terms, the clinical documents control with respect to the care provided.
2. Who We Are
OralMinoxidilOnline.com is an online service of Midwest Mind & Body Healthcare, a Nebraska healthcare practice owned and operated by Kimberly Wohlwend, MSN, APRN, a dual ANCC board-certified nurse practitioner (Family Nurse Practitioner and Psychiatric-Mental Health Nurse Practitioner) licensed in the states where she provides care. Our principal office is 131 N Washington Street, Suite A, Papillion, NE 68046.
Through this Site, Ms. Wohlwend reviews online intakes and, when clinically appropriate, issues prescriptions for oral minoxidil for the treatment of hair loss in adult patients residing in the states where she is licensed.

4. Eligibility & Accurate Information
- You must be at least 18 years old to use the Site and to receive care from us. We do not treat patients under 18.
- You must be physically located and a resident of a state where we are licensed at the time of your intake. See Section 5 for the current list.
- You must provide truthful, accurate, and complete information on the intake form and in any follow-up communications. Clinical decisions depend on the information you provide; withholding or misrepresenting information may cause harm and may result in refusal or termination of services without refund.
- You must promptly disclose if you are pregnant, trying to conceive, or breastfeeding. Oral minoxidil is not recommended during pregnancy or breastfeeding.
- You must tell us about all other medications, supplements, and significant medical history, including (without limitation) cardiovascular conditions, kidney or liver disease, and low blood pressure, because these may affect the safety of oral minoxidil.
- If you are acting as a personal representative or legal guardian for another adult, you must have legal authority to do so and must document it as we request.
5. Scope of Services
Through this Site we offer a single service: a clinician-reviewed online intake and, where appropriate, an oral-minoxidil prescription transmitted to the pharmacy of your choice, valid for one prescription year, with annual renewal available through a brief follow-up intake.
States served. Oral-minoxidil prescriptions through this service are available to residents of the following states: Arizona, Colorado, Idaho, Illinois, Iowa, Kansas, Kentucky, Maine, Montana, Nebraska, New Hampshire, New Mexico, North Dakota, South Dakota, Utah, and Vermont. This list may change; the state-specific service pages are the authoritative source at any given time.
What we do not do. We do not diagnose or treat conditions other than hair loss through this Site. We do not prescribe controlled substances through this Site. We do not provide ongoing primary care, in-person visits, urgent care, or emergency care through this Site. If we identify a health concern during intake that is outside the scope of what this Site offers, we will tell you and will refer you to an appropriate provider.
6. Informed Consent to Asynchronous Telehealth
The service offered through this Site is asynchronous telehealth, meaning a licensed clinician reviews your written intake, health history, and any information you provide without a real-time audio or video visit. By submitting an intake, you acknowledge and agree to the following. You will also be asked to sign a more detailed informed-consent form before a prescription is issued.
- What asynchronous telehealth is. You complete a secure online intake that asks about your health history, current medications, and goals. A licensed clinician reviews the intake on a different schedule than your submission. If additional information is needed, the clinician will reach out by secure message, phone, or email.
- Benefits. Convenience, privacy, and access for patients who do not need or prefer a live visit for this specific condition.
- Limitations. Asynchronous review has inherent limitations: the clinician does not physically examine you and relies on the accuracy of what you report. Some conditions cannot be appropriately evaluated or treated asynchronously; in those cases the clinician will decline to prescribe and, where appropriate, will suggest an alternative.
- Privacy. We use secure, TLS-encrypted form submission and a secure e-signature and payment platform. See our Privacy Policy for details.
- Location. You must be physically located in a state where the clinician is licensed at the time of your intake. If your state of residence changes, let us know before submitting an intake or before a renewal.
- Withdrawing consent. You may withdraw consent to telehealth at any time. Withdrawal does not affect care you have already received.
- State-specific consent forms. Some states require telehealth-specific consent elements beyond what is described here. Where state law requires a particular form or disclosure, you will be asked to sign it before a prescription is issued.
7. Prescribing & Off-Label Use
Any prescription decision is a clinical judgment. Submitting an intake does not guarantee that a prescription will be issued. We will not prescribe anything we do not believe is clinically appropriate for you. If we decline to prescribe, we will tell you and, where possible, explain why.
7.1 Off-Label Use
Oral minoxidil is used off-label for hair loss. That means oral minoxidil is FDA-approved for the treatment of hypertension but has not been FDA-approved specifically for androgenetic alopecia (the most common type of hair loss). Off-label prescribing is legal and is recognized as standard of care for hair loss in published clinical literature. Before a prescription is issued, we will make sure you understand that:
- The prescription is off-label;
- Minoxidil is used at doses far lower than the doses used for blood pressure;
- Benefits, risks (including cardiovascular and fluid-retention effects), and alternatives have been explained; and
- You accept the off-label use on the basis of that discussion.
7.2 Prescription Transmission
If a prescription is issued, we transmit it electronically to the pharmacy you designate on your intake. You are free to choose any licensed pharmacy, including mail-order options such as Cost Plus Drugs. The pharmacy, not the Practice, is responsible for dispensing and for the medication price. Medication costs are separate from the provider review fee and are billed by the pharmacy.
7.3 Annual Renewal
Prescriptions are generally valid for one prescription year. Continued treatment beyond that period requires a new, brief renewal intake and a new provider review. We do not auto-refill, and we do not maintain a subscription. Renewal is optional and is priced at the same provider review fee in effect at the time of renewal.
8. Payment, Fees & Renewal
- Self-pay only. The provider review fee is self-pay. We do not bill your health insurance for the provider review fee.
- Current fee. The provider review fee is a one-time $50 charge per prescription year (the "Fee"). The Fee may change; the price displayed on the pricing page at the time you submit your intake controls for that intake.
- When you are charged. The Fee is collected through Stripe only after (a) the clinician has reviewed your intake, (b) determined that a prescription is clinically appropriate, and (c) you review and sign the Stripe payment authorization. If the clinician determines that a prescription is not appropriate, you are not charged the Fee.
- Good-faith estimate. Because our service is self-pay, you are entitled to a good-faith estimate of expected charges under the federal No Surprises Act. Your Fee is a flat $50; medication cost is determined by your pharmacy. A written good-faith estimate is available on request.
- Medication cost. Medication is billed separately by your pharmacy. Cost varies by pharmacy, insurance, and coupon programs. We do not receive any portion of the medication price.
- Administrative fees. Additional administrative services (for example, form completion or records transfer beyond what is required by law) may carry separate fees, which we will disclose in advance.
9. Refunds
Our refund policy is designed to be simple and fair:
- If no prescription is issued, you are not charged. The Fee is only collected after you sign a payment authorization, which happens only when a prescription is being issued. There is nothing to refund if treatment is not appropriate.
- Once a prescription is issued, the Fee is non-refundable. The Fee compensates the clinician for the time and professional judgment invested in reviewing your intake and issuing the prescription. That work has been performed and is not returnable.
- Exceptional circumstances. If you believe your payment was processed in error (for example, a duplicate charge) or that there is another good-faith reason for a refund, contact us at the details in Section 19. We consider requests on a case-by-case basis.
- Medication returns. Medication is dispensed by your pharmacy under its own refund policy. We do not process medication refunds.
10. Website Content & Intellectual Property
All content on the Site, including text, graphics, logos, photographs, and the overall design, is owned by or licensed to Midwest Mind & Body Healthcare and is protected by U.S. and international copyright and trademark laws. You may view and print content for your personal, non-commercial use. You may not reproduce, distribute, modify, publicly display, or create derivative works without our prior written consent. "OralMinoxidilOnline.com" and "Midwest Mind & Body Healthcare" and our logos are trademarks of the Practice.
11. Third-Party Links & Services
The Site may link to third-party websites or services (for example, our payment processor Stripe, the website of our affiliated practice Midwest Mind & Body Healthcare, Cost Plus Drugs, or other medical resources). We do not control those sites and are not responsible for their content, privacy practices, or availability. Linking is not an endorsement. Your interactions with any third-party site or service are governed by that party's own terms and privacy policies.
12. Disclaimers
The content of the Site is provided for general informational purposes only and does not constitute medical advice, diagnosis, or treatment. Always seek the advice of a qualified clinician with any questions you may have about a medical condition. Never disregard professional medical advice or delay seeking it because of something you read on this Site.
Prescriptions are not guaranteed. Treatment outcomes vary between individuals, and we make no representation that oral minoxidil will produce any particular result for you.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. 13. Limitation of Liability
NOTHING IN THESE TERMS LIMITS OR EXCLUDES OUR LIABILITY FOR PROFESSIONAL NEGLIGENCE IN THE DELIVERY OF CLINICAL CARE, NOR DOES IT LIMIT ANY LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED UNDER APPLICABLE LAW.
SUBJECT TO THE PRECEDING SENTENCE, TO THE FULLEST EXTENT PERMITTED BY LAW, (A) NEITHER WE NOR OUR OWNERS, EMPLOYEES, CONTRACTORS, OR AGENTS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE; AND (B) OUR TOTAL CUMULATIVE LIABILITY ARISING FROM YOUR USE OF THE SITE (AS OPPOSED TO CLINICAL CARE) WILL NOT EXCEED THE GREATER OF (I) THE TOTAL FEES YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (II) FIVE HUNDRED U.S. DOLLARS ($500.00). Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, our liability is limited to the smallest amount permitted by law.
14. Indemnification
You agree to defend, indemnify, and hold harmless the Practice and its owners, employees, and agents from and against any claim, loss, liability, or expense (including reasonable attorneys' fees) arising from (a) your misuse of the Site, (b) your breach of these Terms, (c) your provision of false, inaccurate, or misleading information on the intake, or (d) your violation of law or of the rights of any third party. This provision does not apply to claims arising from our clinical care of you, which are governed by applicable medical-malpractice and professional-liability law.
15. Governing Law & Dispute Resolution
These Terms and any dispute arising out of your use of the Site are governed by the laws of the State of Nebraska, without regard to its conflict-of-law principles. Clinical claims are separately governed by the medical-liability and licensing law of the state where the care was delivered.
For disputes about the Site or these Terms (as opposed to clinical care), you and we agree first to attempt in good faith to resolve the dispute by direct discussion for thirty (30) days. If the dispute is not resolved, either party may file suit in a state or federal court located in Sarpy County, Nebraska, and both parties consent to personal jurisdiction there.
Nothing in this section limits any right you have to file a complaint with a state medical or nursing board, a state attorney general, the U.S. Department of Health and Human Services Office for Civil Rights, or any other government regulator.
16. SMS, Text & Automated Communications (TCPA)
If we communicate with you by SMS or automated calls (for example, a follow-up to your intake, a renewal reminder, or a pharmacy alert), we comply with the Telephone Consumer Protection Act (47 U.S.C. § 227), Federal Communications Commission implementing rules, and applicable state telemarketing and do-not-call laws.
- Consent at intake. You will be given the opportunity to provide express written consent to receive SMS or automated voice messages at intake. You will receive care-related text messages only after you have opted in, and you may opt out at any time.
- Message types. If you opt in, messages may include intake status updates, renewal reminders, pharmacy-related alerts, and other care-related messages. We do not send marketing or promotional SMS.
- Frequency and rates. Message frequency varies based on your care. Message and data rates may apply, depending on your mobile carrier and plan.
- Opt out. You can stop text messages at any time by replying STOP to any message from us. For help, reply HELP. Opting out of SMS does not affect your ability to receive care by other channels (phone or email).
- Privacy. SMS is not fully secure. We will not include clinical detail in SMS beyond what is necessary to identify the message (for example, "Your renewal intake is available"). Anything clinically sensitive will be handled through secure channels.
17. Changes to these Terms
We may update these Terms from time to time. The "Last Updated" date at the top shows when the current version took effect. Material changes will be posted on this page for a reasonable period. If you continue to use the Site after a change, you agree to the updated Terms.
18. General Provisions
- Entire agreement. These Terms, the Privacy Policy, and any clinical-consent documents you sign together form the entire agreement between you and us regarding the subject matter and supersede any prior agreements.
- Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force and effect.
- No waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.
- Assignment. You may not assign these Terms. We may assign them in connection with a merger, sale, or other corporate transaction.
- No third-party beneficiaries. These Terms do not create rights in any third party.
- Electronic communications. By using the Site or submitting an intake, you consent to receive communications from us electronically (for example, by email) and agree that such communications satisfy any legal requirement that communications be in writing.
- Force majeure. We are not liable for delays, interruptions, or failures caused by circumstances beyond our reasonable control, including technology outages, vendor failures, natural disasters, severe weather, fires, power or telecommunications failures, labor disputes, acts of civil or military authority, and public-health emergencies.
